Terms of service

Effective date: September 6, 2026

These terms govern your use of BrandTeam AI, which is operated by WiscAI, Inc. By creating an account or using the product, you agree to them. If you are agreeing on behalf of a company, you are telling us you have the authority to bind it.

1. What the service is

BrandTeam AI writes marketing campaigns in a brand's own voice, learned from that brand's past work, and runs a set of checks on every piece before a person reviews it. It routes work through your own approval chain, records what happened, and exports the finished copy. It is sold as a self-serve subscription and as a managed program where our team sets the voice up with you.

2. Accounts

You are responsible for what happens under your account, for keeping sign-in credentials private, and for the people you invite. Tell us promptly if you think someone has got in who should not have. You must be 18 or older.

3. Your content, and who owns what

You own what you bring: your past campaigns, your brand rules, your source documents, and your briefs. You also own the copy the product writes for you, and you may use it commercially. We claim no rights in either beyond what we need to run the product for you.

You give us permission to store, process, and transmit your content for the purpose of operating the product for you, and for no other purpose. We do not use your content to train AI models and we do not use it to improve another customer's results.

You are telling us that you have the right to upload what you upload. Do not upload anything you do not have permission to use.

We own the product itself: the software, the workflows, the check packs, the templates, and everything we build. Nothing here transfers that to you.

4. Acceptable use

Do not use BrandTeam AI to:

  • Break the law, or write marketing that breaks the law.
  • Impersonate a brand or a person you are not authorized to speak for.
  • Produce content that is deceptive, defamatory, hateful, or sexual.
  • Upload someone else's confidential information without permission.
  • Reverse-engineer the product, resell access, or run it for a third party without a partner agreement.
  • Interfere with the service or work around its limits, security, or metering.

We may suspend an account that is doing any of these, and we will tell you why.

5. The review is yours

The product drafts and checks. A person on your side approves, and nothing publishes itself. AI writing can be wrong, and the checks catch what they are configured to catch and nothing more. Read what you send.

The compliance features, including the rule packs, the claim checks, the required disclosure counts, the packets, and the sign-off step, are a record-keeping and review tool. They are not legal advice, they are not a legal review, and they do not make anything compliant on their own. The starter rule packs are sensible defaults written by us, not by a regulator, and a qualified person at your organization should read and adjust them before you rely on them. Your compliance officer or registered principal is responsible for approving what ships, exactly as they were before.

BrandTeam AI is also not a books and records system. If your firm has to retain records in a particular format, on particular media, or for a particular number of years, keep your own copy. Do not treat our audit trail or a compliance packet as your retention of record.

6. Plans and billing

Plans are priced by how many brands you run and which workflows you use, and each has a monthly limit on how much you can generate. Prices are on the pricing page. Paid plans are billed monthly in advance. To start a paid plan, change one, or cancel, write to us and we will action it before your next invoice. If we later switch on card payment and automatic renewal, we will tell the account owner first and you will be able to cancel from your own settings.

Cancel and your plan runs to the end of the period you have paid for, then stops. We do not give partial refunds for a month already started, except where the law requires one. If we change prices we will tell the account owner at least 30 days before it affects you.

The free plan is free, has limits, and marks its exports as drafts. We may change or end it, and we will give notice before we do.

Managed programs and any partner arrangement run under a separate signed agreement. Where that agreement and these terms disagree, that agreement wins.

7. Availability and changes

We aim to keep the product running and improve it continuously, which means features change. We do not promise uninterrupted or error-free service on these terms, and we have not committed to an uptime number here. If you need one, it belongs in a signed agreement. If we retire something you depend on, we will give the account owner reasonable notice.

8. Ending the agreement

Write to us to close your account and we will. We can end or suspend an account for a serious or repeated breach of these terms, or for non-payment, and outside an emergency we will tell you first and give you a chance to fix it. Export your content before you close the account. After it closes we delete your content on the schedule in the privacy policy.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure, or that the copy it produces will suit your purpose or comply with any law that applies to you.

10. Limitation of liability

To the maximum extent permitted by law, WiscAI, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of or relating to the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or one hundred US dollars if you paid us nothing.

This limit does not apply to liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.

11. Your responsibility for your content

You will defend and cover WiscAI, Inc. against claims brought by someone else arising from the content you upload or publish, from your use of the service in breach of these terms, or from your breach of a law that applies to your marketing.

This works both ways in practice. We will tell you about any such claim promptly, let you control the defense with counsel of your choice, and not settle it in your name without your agreement. None of it applies to the extent the claim is caused by our own breach of these terms, our negligence, or our infringement of someone else's rights.

12. Disputes and arbitration

Any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You and WiscAI, Inc. each waive any right to bring a claim as a plaintiff or class member in a class or representative action.

Either of us may still go to small claims court, and either of us may still seek an injunction in court. You may opt out of arbitration by writing to hello@wiscai.com within 30 days of your organization first accepting these terms, or within 30 days of us posting a change to this section. Each of us pays our own costs unless the arbitrator decides otherwise.

13. Governing law

These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of laws provisions. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts in Dane County, Wisconsin.

14. General

These terms, the privacy policy, and any signed agreement between us are the whole agreement about the service. WiscAI, Inc. may assign them in a merger, acquisition, or sale of assets; you may not assign without our written consent. If a provision is unenforceable, the rest stays in force. Not enforcing a right does not waive it. Neither of us is liable for delays caused by events beyond reasonable control.

We may update these terms. The effective date above shows the last change, and we will tell the account owner before a material change takes effect. Continuing to use the service after that means you accept the update.
